It is to be noted that during Mughal Empire the East India Company by taking settlement and with permission from Mughal Badshah created the three presidency towns namely Madras, Bombay and Calcutta and said East India Company introduced the English legal system for administration of the presidency towns and thus the English Judicial system got entry into the territory of Indian Sub-continent. The filing of the appeals from the then India in the Privy-Council in England was introduced by the said Charter of 1726 and thereafter to bring about change in the management of the then East India Company, the East India Company Regulating Act, 1773 was introduced to place the East India Company under the control of the British Government and provision was made for establishment of a Supreme Court of judicature at Fort William, Calcutta, through Charter or Letters Patent. The Supreme Court of Judicature at Fort William in Bangal was established by Letters Patent issued on March 26, 1774, which as a Court of Record had power and authority to dispose of all complaints against the Majesty's subjects in respect of any crime, suit or action arisen within the territory of Bengal, Bihar and Orissa. By an Act passed in 1833 the Privy-Council was transformed into an Imperial Court of unimpeachable authority, which played a great role as an unifying force for establishment of rule of law in the Indian Sub-continent.

107. (1) Subject to any law made by Parliament the Supreme Court may, with the approval of the President, make rules for regulating the practice and procedure of each division of the Supreme Court and of any court subordinate to it.
 
 
(2) The Supreme Court may delegate any of its functions under clause (1) and article 113 and 116 to a division of that Court or to one or more judges.
 
 
(3) Subject to any rules made under this article the Chief Justice shall determine which judges are to constitute any Bench of a division of the Supreme Court and which judges are to sit for any purpose.
 
 
(4) The Chief Justice may authorise the next most senior judge of either division of the Supreme Court to exercise in that division any of the powers conferred by clause (3) or by rules made under this article.

Appointment of Supreme Court Judges

The process by which judges are appointed in the judiciary is an important factor to safeguard judicial independence. In establishing rule-based government, an independent judiciary plays a substantial role. In Bangladesh, following the Masdar Hossain case, the subordinate judiciary was formally separated from the executive in 2007. However, the process of appointment of judges in the Supreme Court of Bangladesh still rests in the hands of the executive. 

According to Article 95(1) of the Constitution of Bangladesh, the President can appoint the Chief Justice. The High Court Division (HCD) and the Appellate Division (AD) judges are appointed by the President in consultation with the Chief Justice. 

Nevertheless, the President, under Article 48(3) of the Constitution, has to act in accordance with the advice of the Prime Minister except when appointing the Chief Justice. This ultimately vests a significant portion of the power of appointing justices in the hands of the cabinet. Hence, to ensure that the process of appointing judges does not rely on the hands of the executive, a Supreme Judicial Council could be formed like the one during the regime of the caretaker government in 2007-09.

95. (1) The Chief Justice shall be appointed by the President, and the other Judges shall be appointed by the President after consultation with the Chief Justice.
 
 
(2) A person shall not be qualified for appointment as a Judge unless he is a citizen of Bangladesh and –
 
 
(a) has, for not less than ten years, been an advocate of the Supreme Court ; or
 
 
(b) has, for not less than ten years, held judicial office in the territory of Bangladesh ; or
 
 
(c) has such qualifications as may be prescribed by law for appointment as a Judge of the Supreme Court.
 
 
(3) In this article, “Supreme Court” includes a court which at any time before the commencement of this Constitution exercised jurisdiction as a High Court in the territory of Bangladesh.

94. (1) There shall be a Supreme Court for Bangladesh (to be known as the Supreme Court of Bangladesh) comprising the Appellate Division and the High Court Division.
 
 
(2) The Supreme Court shall consist of the Chief Justice, to be known as the Chief Justice of Bangladesh, and such number of other Judges as the President may deem it necessary to appoint to each division.
 
 
(3) The Chief Justice, and the Judges appointed to the Appellate Division, shall sit only in that division, and the other Judges shall sit only in the High Court Division.

The Supreme Court is composed of two divisions: the Appellate Division and the High Court Division.

  1. Appellate Division: The Appellate Division of the Supreme Court is the highest court of appeal in Bangladesh. It primarily hears appeals from judgments and orders of the High Court Division. It consists of the Chief Justice of Bangladesh and a maximum of six other judges. The decisions of the Appellate Division are binding and have precedential value.

  2. High Court Division: The High Court Division of the Supreme Court is the court of original jurisdiction and deals with various types of cases, including constitutional matters, writ petitions, criminal cases, and civil cases. It has the power to issue writs for the enforcement of fundamental rights and to exercise judicial review over the actions of the government and other authorities. The High Court Division consists of a Chief Justice and a maximum of 99 other judges.

The Chief Justice of Bangladesh is the head of the judiciary and is appointed by the President of Bangladesh. Other judges of the Supreme Court are also appointed by the President upon the recommendation of the Chief Justice and in consultation with the other judges.
