Proximity means nearness or closeness. If the defendant is physically close to the claimant it is more likely there will be proximity. It comes from the neighbor's principle of the (DONOGHUE V. STEVENSON case).

Negligence means a failure to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances .
