Mediation
Mediation involves an impartial third party who listens and directs discussion but does not suggest outcomes.
**Mediation is not binding
**All parties have their say
**Atmosphere is informal
Time limitation:
The mediator must be selected within 10 days.If not, then the court will make selected within the next 7 days.
Disputes shall be resolved by mediation within 60 days.If you can't for any reason then the court will give you 30 days time.
**The mediation decree does not run on appeal or revision.
Example :
Oli and Polly fight and come to one of their elder brothers and give judgment that brother Oli killed me.Then they called their elder brother Oli and said that you will not fight. You are two friends from today.This is the mediator that the third party resolved.
***Any solution reached through mediation should be reported to the court.If the court itself does it in the mediate., it has to give a report.
If the mediation fails, the court procedure will start from the hearing.
If the court fails to mediate then the case cannot be filed in that court.
**Plaintiff's or defendant's nominated lawyer cannot be a mediator
**No Government servant can be a mediator
**Any lawyer or District Judge shall be the mediator
