A breach of a
condition may be treated as a breach of a guarantee in certain circumstances.
As a result, the buyer loses his right to cancel the contract and is limited to
suing for damages.
1.Buyer's voluntary
waiver: Although the buyer has the right to treat the contract as repudiated
and reject the products if the seller breaches a condition, he is not obligated
to do so. Instead, he can choose to waive the requirement and accept the
products, then sue the seller for breach of warranty damages.\
2. Buyer's
acceptance of goods: If the buyer accepts the products and then learns of the
breach of condition, he cannot reject them; instead, he can pursue a claim for
damages.
